Legal Question in Criminal Law in New Jersey

dui in nj

i am a police officer charged with agg ass by motor vehicle and dui. my 1st attorney was ineligible to practice law in nj. i paid 5k. fee arbitration granted me 2.5 back which was never paid. my current lawyer was paid 6500.00 and now thinks the prosecutor will get a conviction plus wants 10k more b4 i goto trial. is there anything i can do at this point?? trial is nov 2nd?? i feel im running out of options and need advice badly!!

Regarding collecting on the $2,500.00 awarded you by the fee arbitration, if you do not get paid by the former attorney then you can sue him for that amount in small claims court. Regarding your pending trial, you have a very complicated case and without reviewing all of the evidence and any plea offers made to you or your attorney, I can't give you a full answer. What county are we talking about???

I have defended people charged with DUI in Souhtern NJ for more than 15 years, and like to think I give my clients peace of mind because they know I'll do everything possible (legally) to win their case. You may have read about me in local papers or seen me around the local Courthouses... I know my reputation often preceeds me.

I would not charge the type of fee that has been requested, nor would I ever think to charge a client a fee that has not been detailed in a retainer agreement beforehand. It sounds like your lawyer knows you are scared and wants to capitalize on your fear, and is charging you a big fee because he thinks you'll pay. Is any portion of the charge for an expert to testify at trial???

You are supposed to have a written fee agreement. Do you have one? If your current lawyer believes you will be found guilty, you will. It is the power of negative thinking.
