Legal Question in Criminal Law in New Jersey

duress

My boyfriend went to court for theft charges that were 5 years old. The charges were origionally filed by his mother (her controlling husband made her do it) when we went to court his mother said she wanted to drop the charges but the police said they were pressing charges. The prosicuter told my boyfriend that either he could confess and pay the fine or his mother would go to jail for lying. Can they legally do this?

Yes, it happens a lot with domestic violence cases. I suggest he get a good attorney ASAP. A good attorney should be able to put a stop to this pretty quickly so that everyone walks away ok.

Sounds like you went to court without an attorney to defend you and someone almost got screwed. You need to hire a good attorney who charges reasonable fees. That would be yours truly.
