off duty officer

if a off duty cop is in a bar and starts a fight can he charge u with assualt on a police officer when u didn't know he was..and u were just defending yourself from him...thank u

No, of course not. Just because someone is a cop doesn't mean that they have a halo of extra protection with them at all times. Now if they identify themselves as an officer for some reason and then something happens, that would be different.

He can charge you but you would only be guilty if he displayed a badge or other item giving notice he was a police officer. He can be charge with assault.
