Legal Question in Criminal Law in New Jersey

Early end to probation?

I have heard that after serving the first half of my probation, if there were no problems, I can petition the court to change the sentence and release me early.

Is this true? Is it worth pursuing? What's the likelihood of winning? What are the factors the judge looks for? What are the disqualifying factors?

It's a first offense. I never missed an appointment with my Probation Officer. I was never behind on my payments. I completed all other requirements of the probation in the first few months. No other legal problems.

Re: Early end to probation?

Usually the probation officer makes the motion to terminate probation early. It might be the better course to speak with the officer to confirm he or she would not object to early termination of probation because you will not get very far with a motion without the officer's

recommendation of termination.

Call me if you like.

As Mr. Moore said, a lot will depend on your PO. However, even without their consent, you still have a good shot. We've done this before with good results but each case is different. Look at it this way, you have nothing to lose except some money and it shouldn't be that expensive. My initial consultations are always free so call me at 732/247/3340 and we'll discuss your case and your options.

Good luck!
