Legal Question in Criminal Law in New Jersey
early termination (probation)
I was about to move out of the USA when this has happen(Im Canadian)
I was arrested 8/23/07 and I stay in Hudson Correctional Center until the 10/13/07 before I was able to reach a relative to pay a bail for me.
After I was placed in a program call PTI (pretrial intervention program) in general for first offenders ( for one year.)
I start the 3/3/08 and I have fully complied with all requirements, community service and pay all the expenses. I never missed an appointment with the probation officer,(I ask permit to go to Canada and was granted and I come back in time).
Last 8/1/08 I ask if an early termination was possible because I want to to move out of the country .(no coming back). Because I have better chance of work and my friend live in other country.
The judge asks to the Officer for how long I have been in PTI and them he said no.
When I must ask against .?
What may happen if I leave the country before probation period is terminated,(Im not coming back).

Re: early termination (probation)
If you leave the country permanently before you complete your probation you will become a fugitive and a warrant will be issued for your arrest. You can ask for an early termination of probation at any time, but as you know the judge is the one who decides if this will be granted.

I don't really follow your entire situation. I suggest you pick up the phone and call an attorney to discuss your case.
Re: early termination (probation)
If you do not complete your period of P.T.I supervision you will have to face prosecution on the crime which gave rise to your P.T.I application. If you have already pled guilty you will be sentenced and the sentence might involve time in prison.
As for a second application to terminate you P.T.I. what you need is to change the nature of your P.T.I supervision so that you need not report physically. You need an attorney for this. I am available and knowledgeable.
Call me if you like.
