Legal Question in Criminal Law in New Jersey
Electronic Threats
When I ended intimacy with a newark nj police officer he sent an email telling me that he had aids virus and had it for a long time and was going to die and made a referrence to his brother who previously died of aids.I contacted newark internal affairs I participated in 2 taped interviews which they asked me very sexual based ?'s including describing his manhood and any sexual fetishes he had I don't understand what these ?'s have to do with the issue they took it to the county prosecutor office and according to ia they came back with harassment which is a disorderly offense I asked ia why are they charging a lesser crime they responded because it's not known If he actually have the virus and claims that when we go to municipal court that the judge will order a blood test for him and can amend the charges I contacted a prosecutor in newark and she said that that's not true that the harassment charge is just for the email being sent not for the content in order to bring charges on the content I would have to file a complaint on the basis that he says that he has knowingly transmitted the virus to me and that's assault.I ? ia about this and they claim that's not true. What shall I do? Is anyone right?

Re: Electronic Threats
The prosecutor is correct. You need to speak with an Essex COunty Prosecutor investigator, not the Newark Police internal affairs people. If this person really had AIDS and he knowingly passed it on to you, this could easily be seen as a case of aggravated assault, which is a first degree crime. Talk to the prosecutor's office first thing next week and tell them you want ot bring felony charges against this police officer who did this to you.

Re: Electronic Threats
First, let me say that I am sorry you are going through this horrible situation.
My first question is have you had an HIV/Aids test? If you haven't you should.
Second, being a former assisistant prosecutor, I know the prosecutor's office has discretion on how to charge the officer. They do this based on the evidence presented. To be able to understand the issues more, I would need more information about the evidence in the case. Did they obtain a statement from the police officer?
Third, it appears to me that, if the evidence was strong enough, the charge should be an aggravated assault or even attempted murder.
Also, why is your caption entitled "electronic threats?"
Please contact my office if you wish to discuss your case further.
