Legal Question in Criminal Law in New Jersey
Entrapment by police
I have heard that it is the case that if a cop is trying to catch you in the act of a crime by means of a ''sting,'' if you ask that officer if he/she is indeed a cop or is affiliated with any law enforcement agency of any kind he/she must tell you or it is entrapment. Is this indeed the case?

Re: Entrapment by police
What you described is not entrapment. If you are committing a crime and the police are acting undercover and pretending to go along with the crime, they are allowed to do this and they do not have to tell you they are a cop. If the police create a situation which entices you to commit a crime you might not otherwise have done, this may be entrapment. I am an attorney who has handled many criminal cases similar to this one in the past. Please call me at 908-272-0111 to discuss your case in more detail. There is never any charge for simply consulting on a criminal case with me. Sincerely yours, -Ronald Aronds, Esq.
Re: Entrapment by police
Trickery by the police is not only legal but it is expected that they outsmart so-called criminals. Where the police go astray is where they overcome the individual will of a person so that but for the police conduct the person would not have committed the crime.
When the police are asked if they are police while tricking so-called bad guys they are supposed to deny that they are the police. There are concerns that a bad guy might injure or kill. an undercover officer whose identity becomes known
To answer the question as to whether entrapment is a defense that might be accepted by a jury or other trier of fact I need to know all of the facts and circumstances of the police conduct and the circumstances of the alleged criminal activity.
Call me so that we can discuss your question on the basis of better information.
