Please explain the law of NJS 2C:33-4A

On New year's weekend we dropped off my step daughter at her fathers during this extended visit we tried to contact her via telephone, which my wife's ex had temporary disconnected. In the Past my wife's ex has take the kid out of state without her knowledge; put her on a motorcylce without her knowledge, which is against their divroce decree and many other numerous events like trying to get her arrest before saying she used his insurance, which we prove wrong by one phone call but my wife had to miss a day of work to reach something he could have done, but choose to bust her stones instead.

So after numerous attempts over the New year's weekend and no telphone call from my stepdaughter on New Years eve we had a wellness check done at his home at 12:30 am new years eve. He has since then filed a citizens complain against her for violation of NJS 2c:33-4A. My concern is the an offical arrest. or a bogus charge? Do we need an attorney? and what are our concerns with this matter.

Your wife is being charged with harassment, what is known as a Petty Disorderly Persons Offense.This is a violation of the New Jersey criminal code, although admittedly it is the lowest level type of violation of the NJ criminal code. If she is convicted she will have a record. If she is convicted the maximum penalties are $500.00 in fines, 30 days in jail, and $150.00 to $200.00 in additional mandatory monetary penalties. Do you need a lawyer? I would never advise someone to go to court on a criminal charge without a lawyer, so I would have to say that she should get a lawyer. The judge may even advise her to get a lawyer since, even though it is a citizen's copmplaint, it is still a criminal charge. The person bringing the charge will have to prove that your wife harassed him. I don't know how he could do this, unless he recorded her messages or saved any voice mails she left for him. I am an attorney who has handled many cases similar to this in various courts throughout NJ in the past. I would like to discuss this case with you in more detail.
