Legal Question in Criminal Law in New Jersey

Expungement of a criminal record

Wanted to know, what is the time frame that is required to pass before a criminal record can be expunged. The OFFNS: 2C:20-3A and description says: Theft by unlawful taking. I had to pay a fine of 405$.00 and now I want to expunge this.

Re: Expungement of a criminal record

Generally, for the offense as you have entered it, the period is 10 years from the date of conviction/ date you paid your fine/ or date you ended probation/were released from incarceration (if any).

However, there are many factors that need to be analyzed, such as subsequent trouble with the law, the circumstances of your crime, etc. that may affect the 10 year period or possibly dictate that your record may not be expunged.

As above, the 10 years time frame is generally accurate, however, if you are located in South Jersey and wish to have an attorney's assistance with this matter, please contact me at your convenience.
