Legal Question in Criminal Law in New Jersey

Expungement of Federal Misdemeanor

If someone was given a ticket under the CFR for simple possession of marijuana, less than a gram, carrying a fine of $200, but they instead went into, and successfully completed, a PTI program - having never admitted nor been found guilty - can that person get their record expunged?

Re: Expungement of Federal Misdemeanor

I'm not sure what you mean by the CFR in this context, but under New Jersey State Statutes (Not Federal law, where the CFR would be found)if you successfully complete a PTI or Conditional Discharge program, then this is the equivalent of an expungement and you will not have a criminal record for that offense. Hence, you will not need to get an expungement of the charge. However, you will still have an arrest record, and that can be expunged once you complete the terms of your PTI.
