Expungment

If the Prosecutor dimisses a complaint due to lack of evidence, do you need to file a petition for Expungment to have your fingerprints and photo removed from record, or is this part of the due process of Law? Also, how can you be sure this has been done?

A dismissal of the compalint just dismisses the complaint. A record of the arrest remains. To remove all of that, I suggest you contact an attorney to get an expungement.

Records are intregal to civilization; they are never destroyed. In an expungement an Order is signed and served upon the local and state policel in New Jersey and all courts with records relating to the offense and the FBI barring the release of this information to the public and authorizing the defendant to tell the world that he has no criminal record.

Expungment

The government keeps your fingerprints and photo forever, whether you get an expungement or not. What the expungement does is "seal" the information so that it becomes not available when prospective employers and others do record checks. The expungement also allows you to answer, even under oath, that the arrest never happened.
