Legal Question in Criminal Law in New Jersey
Exspongement
I plead guillty to an assult charge in 1982 and in 1986
plead guilty on a simple possesion of cocaine. I did my
probation and paid my fine, now I need it erased or
pardoned, I don't know if exspongement will erase and
clean up my record. I'm trying to clean up my past
history.
I have not been in trouble since than and I'm wondering
how to go about having these 2 items removed from my
background checks?
Thank-You

Re: Exspongement
As long your conviction for the cocaine was a disorderly persons offense, and as long as five years have passed from the END of your probation, you can petition for an expungement of both charges.

Expungement
New Jersey expungement laws are quite complicated and, sometimes, quite illogical. Your situation is an example.
Based on the information that you provided, your cocaine conviction can be expunged. Your assault conviction, however, can NOT be expunged. Note: I am assuming for purposes of this answer that your assault was a simple assault. If your assault conviction was for aggravated assault, then you can have neither of your convictions expunged.
Good luck.
Re: Exspongement
It is difficult to provide an accurate answer to your question since there are a number of unkown variables. For many offenses, however, there are procedures whereby your record can be expunged after either 5 or 10 years depending on the offense.
I offer free consultations and handle expungements. Contact me so we can discuss the details of your particular case and I can do some research and then give you a firm answer.
