Legal Question in Criminal Law in New Jersey
False id
My son was in line at a public venue with friends over 21 and handed his friends id over to the gate with no intent in getting a wrist band for himself. The police asked him to step aside grabbed his wrist and proceded to give him a ticket for use of false id

Re: False id
If your son and his friend are willing to testify in court that he was just doing some kind of favor for his friend by handing his friend's ID to the person at the gate he might have a chance of beating this ticket. Please call me to discuss your son's case in more detail. I never charge for simply talking to a person about their case. Thank you.

Re: False id
So what is your question? If you are going to say can be get out of the ticket, the question is, was he going to present the ID as his own? If not, WHY did the guy hand it over to him? If you came up with even a half decent answer to that, then maybe you go before th ejudge and try to get it dismissed. If the reason is not credible, then he'll lose, unless the statute REQUIRES him to use the ID, which he did not, and you can argue that the police can't meet their burden, because they moved too fast, and they can not prove that he would not have changed his mind and not committed the prohibited act if not arrested too early. Get and READ the statute - WHAT do they have to prove to make the summons stick?
Re: False id
In any event he must appear in court and should have an attorney.
Call me if you like.

Re: False id
Did you see the police report? There is a good chance your son is not telling you the whole story. While I do not put it past cops to make up a story, kids are more likely to do it in this situation. Why would he have handed him is ID? Sounds odd. I suggest you get an attorney as this is a criminal offense.
