Falsely accused
My boyfriend is being charged with an aggravated assault for hitting a drunk man in a bar 7 months ago. my boyfriend has appeared at every single court date claiming his innocence and the person filing these charges has been in and out of jail and most of the time the court dates have been postponned in order to accomodate this man. my question is, no one knows exactly who hit this guy and the reason my boyfriend is being charged is because the bartender had a credit card receipt from my boyfriend and that was the only name that was given. how is it that the courts did not take a statement from my boyfriend and this guy has no recollection about that night? this has been going on too long and his lawyer cannot get this thrown out of court.

Based on what you write I believe that there are at least a couple of grounds for petitioning the court to dismiss the charge against your boyfriend. It could be that he needs a new lawyer. I understand that all courts are different and sometimes things are just out of your hands, but based on what you told me, it doesn't sound like he or she has tried everything. I could think of several ways to get this thrown out. Here's a real simple question, what motions have been filed and what was the result? If the answer is no motions have been filed then its time to get a new attorney.
