Legal Question in Criminal Law in New Jersey

Federal charge of counterfeiting currency

I was charged with Manufacturing counterfeit money and distribution 491 (b) and 2 back in december of 2000. December of 2001 I went to court and my public defender advised me to take a plea bargain a (491 (b) 1 year, $100,000 class A misdemeanor). She told me that most likely I will get probation if I took this plea bargain because I have no criminal history, or I will be placed on supervised pre-trial and she was also going to work on a downward departure. Now she calls me and tells me that I will be recieving the max of 1 year in federal prison definetly. Now how would she know that? she is also not going to represent me anymore because of sick leave. I'am being sentenced in june. What could I do? Is it to late for a private attorney

I was arrested and incarcerated in november of 2001 for a local state charge. After I made bail I had to appear in federal court and I was put on the ''bracelet'' house arrest for breaking my bail restrictions because I was arrested for another charge. It will be 7 months that I have been on house arrest when I go for sentencing, if I do get 1 year will my 7 months of house arrest count for anything? like time served. I'm stuck in this mess and I really do need some kind of help here. Thanks

Yes you can still hire a private attorney for the sentencing in the federal matter. It is important to note that the state case may violate you and you may be sent to federal prison.

I am an experience criminal defense attorney, I will be very happy to answer any further questions. I can be reached at 201-646-9600.
