felony

if i am going for a job interview that requires i have a back ground check, a back ground check goes back 7 years something i did in 1996 will it show up. and is shop liffing a felony?

In New Jersey, a state police background check will reveal ANY matters you have ever had regardless of how old they are. Maybe, however, the job only looks back 7 years?

It is impossible to answer for certain whether you were convicted of a felony or a misdemeanor because shoplifting can be either depending on the amount of the merchandise involved. A good rule of thumb is that its a felony if you went to your County Court and probably a misdemeanor if you handled it in your local Municipal Court.

Shoplifting is theft and an offense reflecting moral turpitude. A bank, insurance company, home health aide provider will not hire you if a conviction is known of.

Five years after the payment of the fine, completion of probation and/or completion of any jail sentence disorderly persons offense shoplifting can be expunged by petitioning the Superior Court of New Jersey in the county where the conviction was entered. If you pled guilty to shoplifting in municipal court it was a disorderly persons offense. If you pled guilty in Superior Court, it was probably a criminal offense and ten years is how long one has to wait in order to expunge such a conviction. It take approximately three months to obtain the order of expungement.
