Legal Question in Criminal Law in New Jersey

Fingerprints for job

I have two questions. I was arrested for shoplifting when I was nineteen. The charge was shoplifting since the dollar amount taken was just under that for the higher charge of (grand larceny). I think I was charged with a disorderly persons. Does it show shoplifting or dp on my record? Also, does this show up if I get fingerprinted at my job at a daycare? Can they fire me for it?

My friend who works there also said she has a felony for domestic violence in the state of FL on her record. Does it show up if they run her in Jersey? Can she get fired?

First, the specific offense should show up on your record. Second, it depends on what type of check they do. Most places just do felony checks. What happens it that they send someone down to the county courthouse to look through records. Usually, DP's don't come up unless they were downgraded however, I have seen downgraded case not show up as well.

If they do a full check with the State Police, the DP will surely show up. The Florida record will only show up if they do a FBI check.

You are not under contract so they can fire you at anytime for anything. If they ask you about it, tell them that you were young and made a mistake. Just don't lie about it because that is what gets people in trouble the most.

Regardless of what happens, I strongly suggest you look into getting an expungement. Feel free to contact my office to discuss that. If that goes through, you won't have any record to worry about at all.
