Legal Question in Criminal Law in New Jersey
if you are found not guilty of the charge of violation of n.j.s. 2c:20-3a a disorderly persons offense do you have the right to counter sue for defamation of charactor ?

You may have the right to sue someone, but whether that suit will ever go anywhere is a different story.

Usually, where one is charged with a crime without a reasonable basis for same, and is found not guilty, that person can file what is known as action for malicious prosecution. If you were
held in jail, you can also sue for false imprisonment.
