Re: help

Theft by deception is theft. A conviction for theft will prevent employment by a computer, insurance or banking firm and by many other employers. The seriousness of the offense is governed by the value of the item stolen. Less than $200.00 is a disorderly offense punishable by up to six months jail. If the value of $200.00 or more it is a fourth degree crime punishable by 18 months in jail. If the amount of the loss is $500.00 or more the offense is punishable by up to five years in jail and if the value of the item stolen is $75,000.00 or more it is a second degree crime with a possible ten years and jail and the presumption of incarceration.

As a first offender the charge could be dismissed after a period of supervision by the

probation department. Restitution would probably be required.

Unless it is a second degree theft a first offender's sentence is presumed to not involve jail, but probation.

Re: help

Your friend is looking at heavy fines, potentially some jail time, and having a criminal record should he be convicted of this crime. Depending upon the value of the items stolen, that would determine the severity of the penalties he is facing. No matter what, he needs to consult with an attorney about the specifics of his case. I am an attorney who has handled many cases similar to this in various courts throughout New Jersey in the past. I would like to discuss this case in more detail. Please contact me at your convenience. I never charge for simply talking to a person about their case. Thank you.

Sincerely yours, -Ronald Aronds, Esq.-
