Giving Prosecutor a statement
A 12yr old girl and a 17yr old boy had consensual sex. I dont believe the parent is pressing charges but they took a statement from the girl and want the boy to come in and give his statement. Should he just show up and give his statement or let the police come and arrest him and then call an attorney ? I have the option to take him in b4 friday and let him make a statement, or just wait at this point and do nothing ?

Thank god for this website. CALL AN ATTORNEY RIGHT NOW!!! I mean now. I don't care what time it is. Leave a message. In general, giving a statement (or letting a child give a statement) without an attorney is the worst thing you can ever do in your life. Trust me.

The young man faces the possibility of conviction and spending the rest of his life labeled as a sex offender. DO NOTHING WITHOUT A LAWYER.

Giving Prosecutor a statement
Do NOT go in. The boy should give NO statement. Any statement cannot help him and WILL hurt him. They are NOT his friends. They are seeking material to hang him with later. I say this as emphatically as possible.

NO way. He would be or could be convicted of statutory rape. He needs to retain a criminal defense attorney right away.
