Legal Question in Criminal Law in New Jersey
grounds for a mistrial
My boyfriend was a defendant recently in a criminal case. Two of the jurors slept through part of his testimony. Is this grounds for a mistrial? Also, are there cameras in the courtroom that would have recorded these jurors sleeping?

Re: grounds for a mistrial
If jurors slept during his testimony AND took part in the jury deliberations leading to a verdict, that would be a substantial ground for a mistrial. You can call me at 800 273 7933 and you can visit my website by clicking on www.garymooreattorneyatlaw.com.
The cameras are sound activated. For the jurors to be on camera a speaker would have to be near or next to the jury box.
