Legal Question in Criminal Law in New Jersey

handcuffing a minor

I am 17 and was caught stealing cones at one site. I was with 2 femails of age 16, we where placing the cones in the back as we saw lights coming i went into the car and shut it off, the 2 girls hid infront of the car(We where parked in a little drive that was hidden. I sat in the car and the girls darted for the woods, then i opened the door as he walked by and he did not see me, the girls then came back. I was then cuffed however was not a threat in anyway to the cop. I was thrown in the back of the car and the girls where then questioned when i was sitting in the cop car. Is this correct to cuff a person who contains no threat but most of all only cuff one person and not the other 2. Please help. Thanks!

Re: handcuffing a minor

The police have a lot of discretion in how they control an arrest. The cop really didn't do anything wrong by handcuffing you, even though I agree that it does seem like an extreme reaction by him. He also didn't do anything wrong by NOT handcuffing the girls. I am a lawyer who has handled many cases similar to yours in lots of different courts in New Jersey. Please ask your parents to contact me to discuss the details of the case against you, since you will need a lawyer. My phone number is 908-272-0111. It doesn't cost anything to just talk about a case with me. Thank you.
