Legal Question in Criminal Law in New Jersey
Having harassment charges brought against me.
I have a 10 year old son by a man who is currently married. They have had marital problems and I am now pregnant by him with twins. We have an agreement not to have the courts involved with visitation and custody. Whenever my son wants to see him, I call his cell phone. He purchased the cell phone.Last Tuesday, we met at a park so my son can see him and his wife came out of nowhere and approached me, screaming and hollering. Last Wednesday, me and the guy went to my prenatal appointment and found out that I'm having some complications. She told him that I was not to call or text either her phone or his phone.I went to the police station where the episode on Tuesday night happened and filed a complaint against her.I also asked the cop if she could press charges against me for contacting his phone, the police officer said no. On Friday, I had an ultrasound appt. that he said he would go to. My friend called his phone using my cell phone (SHE left a message), and then about 2 hours later called his phone again to find out if he was going. He didn't answer either time. Later that evening, I received a text from him stating that she filed harassment charges against me and that he'll go to court for me. Any information will be helpful.

I specialize in criminal law cases. The police was wrong in telling you that she cannot charge you with harassment. Anyone can go and file charges against someone. The real question is, can she prove the harassment? (Probable cause!)

I assume that your friend who is going to court with you is an attorney; otherwise I do not know what he can do for you. You need to take an attorney with you and you need to work out some resolution of your situation with the wife with whom you have cross complaints.
There seems to be the potential for violence. Some agreement to stay away from each other might help. The problem seems to be your obvious need for help from her husband.

The fact that he is willing to go to court on your behalf is a big help. It seems like the phone calls were to him and not her and therefore she has no basis to file a harassment charge. I would have to see her complaint and flush out some more details from you.
