Harrasment by wifes ex
My wife's ex husband has been trying to make our life miserable. They have one son together who spends the weekdays with us and weekends with him. He has called dyfus on us for no reason, took the cell phone we gave the boy for communication with us only and ordered billable ringtones numerous times, left anti semetic messages on our phone, stolen gifts that we gave to the boy, is constantly late with child support. I would like to file a legal claim at him to show that we are sick of it and can't be bullied. What can I do. We are in the process with regards to the child support issues, but I would like to file some sort of harrassment charges against him. Do I have a case?

The anti-semitic messages were way over the line; it is a basis for filing a criminal charge against him in municipal court. As for the totality of his behavior you could sue him civilly, but if he has no money you will be just pissing in the wind.

From what you describe it sounds like you certainly have a case for harassment against this man. The procedure is to go to your local police department, explain to them what has been going on, and ask them to do an investigation to bring charges against him. If they won't bring charges, then you can ask them to give you the forms to file a citizen's complaint for harassment against him. She can file a restraining order against him. Either of you can file criminal complaints. If you are just going with the criminal complaints, you don't need an attorney. However, I doubt they will really get you anywhere in the long run. Thus, I suggest you file a TRO for which, I would strongly suggest an attorney.
