my boyfriend had a three year sentence for a minor drug charge, recently his public defender filed for a hearing for reconsideration. my question is, is there anything i can do to assure that he gets probation?

Re: hearing for reconsideration
Since your boyfriend already has a lawyer, the public defender, you really need to ask him for the details about this. However, in general, once you have been given a custodial sentence (jail time), then you cannot get probation - all you could try to do is to get an early PAROLE date to get out of jail earlier than you would normally expect. There is also a program known as ISP that may be applicable in this case and might result in your boyfriend getting out of jail early. Ask his lawyer about this program.
