Legal Question in Criminal Law in New Jersey

Hi,

If one is charged with simple assault statute 2C: 12 - 1A (1). The individual has to go to court on 12/4/09 to plead guilty or not guilty. Does the individual need an attorney on that date or should wait after the pleading for a court date.

Also, until the individual goes to court on 12/4/09, can the individual travel outside of the state for a few days?

You need to hire4 an attorney. The attorney needs lots of time to prepare BEFORE he goes to court.

The simple answer is that to hire an attorney now probably won't cost that much more...

I know we have a policy in our offices regarding initial arraignments, maybe other attorneys follow a similar one. Anyway, we are a low-cost office....or so I hear. Not as cheap as a public defender, but we aren't talking $2500 to defend in Municipal Court either.

Anyway, the right lawyer can make all the difference. You should get protected ASAP.

The first appearance date on a simple assault case like yours is just so the judge can read the charges to you, tell you what your rights are, and to advise you to consult with an attorney. Nothing substantial will happen. You must plead NOT GUILTY when the judge asks you how you plead to the charge. If you want to avoid that extra trip to court, you can hire a lawyer before December 4 and the lawyer can avoid that unnecessary court date by telling the court you have already hired him and he has advised you of your rights.
