Legal Question in Criminal Law in New Jersey
Improper Police Procedure
While being arrested for a petty marijuana offense, police destroyed evidence, instructed perp to destroy evidence, and were scolded by their superior during the arrest. There were witnesses who have said they would testify to this. Can this somehow be cause to dismiss the case?

Yeah, especially the destruction of evidence. It won't be easy though. Call me at 732/247/3340 to discuss.
Re: Improper Police Procedure
The distruction of evidence can be the basis of a motion to dismiss charges against you. You need to confer with an attorney.
Call me if you like.

If they destroyed the evidence I don't see how they can proceed with the case against you. I am an attorney who has handled many cases similar to yours in various courts throughout New Jersey in the past. Please contact me to discuss your case in more detail. I never charge for simply talking to a person about their case. Thank you.
