The rules of evidence are not strictly enforced in grand jury proceedings. The prosecutor can present all evidence that he finds to be relevant to this case to the grand jury. So therefore the prior charge against your son, especially since it involves the same allegations being made by the same girl against him, can be used by the prosecutor in seeking an indictment. Since he has been indicted though, your son will need a lawyer to represent him. I am an attorney who has handled many cases similar to this in various ocurts in New Jersey in the past. By now, he should have an attorney but it doesn't sound like he has a good one huh? Technically, his prior case "could" be used against him, but there are some hurdles that the State would have to jump through first. However, without a good attorney, the State may not be forced to go through these hurdles. Before things go any farther, I suggest he get a "good" attorney that can stand up to the system and save your son. My consultations are always free, so call me at 732/247/3340. A new charge can be filed and must be dealt with, but the prior history is important to an

acceptable disposition of the matter.
