Legal Question in Criminal Law in New Jersey

I need info

I am an out of state resident of New Jersey. I was charged with Consumption wile operating a vehicle. I took the breath test and the results came back .1 I would like to know if it is a DUI or is it what the cop said it is an empty container in the car?

Your charges are whatever the traffic summonses says they are. An opened alcohol container in your car will not cause you to lose your license but dui will if you are found guilty.
