Legal Question in Criminal Law in New Jersey
joy riding
son 16 years old was in car with 3 other teen when a car hit them from behind, son was not driving. They all got out and ran. Do we need to get a lawyer before going down to the station to talk with the police?

Were they in a stolen car? Why would they run. Perhaps the driver had no driver's license?

My advice is, YES of course! I suggest you should never speak to police without an attorney when you may be a suspect. I would politely tell the police that you will be happy to speak with them AFTER you have had time to consult with an attorney. Then call an attorney ASAP.

It depends upon whose car they were "Joy Riding" in. Was it a stolen car? If yes, then he certainly needs a lawyer before talking to the police. Or was it one of the kid's mom or dad's car that they took from their own driveway? If that is the case, and the parent doesn't want to press criminal charges, then you probably don't need a lawyer, but I would certianly make sure that the parent whose car it was went to the police station with the kids.
