Legal Question in Criminal Law in New Jersey

After summer school, my son was to the park to play basketbal with his friends, he became tired and sat down on a bench, when the county police came over to arrest him and charged him with strong arm robbery because someone said he stole their basketball. Three witness came over to the police to tell him that my son did not have anything to do with what happened, but the police refused to listen and told them to mind thier business or they will join him. My son stated that while the police was taking him to the jail, they stated if you tell me what happened, I will let you go and my son responded I don't know and I did not have anything to do with the stolen basketball. First, two men in their 20s was identified as the assailant, then two other boys, but their father was able to speak on their behalf. My son was released to me with no house arrest. How should I handle this? I have a public defender is this the right way to go? Please email with an answer.

If your son is a juvenile then his case will be heard by a family court judge acting in his or her role as a criminal judge. Although I don't like to say bad things about other lawyers, my experience as a private attorney who has done a lot of juvenile criminal cases is that the public defenders are often too eager to just plead people out to the charges they have against them in exchange for a lesser sentence reommendation by the prosecutor. I say this with first hand knowledge because I used to do part time work for the public defender's office. Strong arm robbery is a first degree offense and if your son is convicted of this he is facing actual jail time in the juvenile prison. Also, if he did not commit the crime, then he should not be pressured into pleading guilty. I have not seen the evidence in this case, but from what you describe this sounds like a case that can be beaten.
