Legal Question in Criminal Law in New Jersey
If your laywer sends a letter out for the discovery for a harassment charge, and only gets the paper of the complaintive back and there is no tape of the voicemail or any copies of any txt messageing in the discovery packett would the most likely get dismissed?

First of all, your lawyer should be answering all of your legal questions. Moving on, judges rarely look to dismiss cases right away. Your lawyer should move to dismiss for lack of probable cause which should prompt a PC hearing.

If it is a criminal case an objection should be made to any evidence not provided in discovery.
