Legal Question in Criminal Law in New Jersey

legal grounds

was charged with dwi refusal after my car was stolen. which would would make the person who stole, legaly the operater of the vehicle of said time.i have the police report to prove it,since the state has to prove operation technicaly i wasnt right? please help.

I don't quite understand the facts of your case. Are you saying that you were arrested for DWI even though you weren't driving at the time you were arrested (because you were not in possession of your car)? If that is so, I can't imagine how you could have even been given any ticket. In answer to yor question however, Yes, the state has to prove the case against you. If you have an actual defense, specifically that you did not even have possession of a car at the time you were given the tickets, then you can probably win your case. You are warm. Your defense will probably be that you were not operating your vehicle when drunk because the officers viewed you and tested you long after your vehicle was taken and long after you had parked the vehicle.
