Legal Question in Criminal Law in New Jersey
Letter to Judge
My boyfriend is going to trial in feburary for an assault charge in the 4th degree. I was wondering if I write a letter to the judge about his character and the fact that he is trying to get himself on track will change his sentencing if he is found quilty

Re: Letter to Judge
The Judge will consider a letter. But if you go in person to read or tell the judge what's in the letter it will show that he has family that is interested in his well being.
The Judge does consider mitigating factors when sentencing.

Re: Letter to Judge
First of all, did the prosecutor offer any plea on this case? Does your boyfriend have a prior record? If not, why is he not in PTI?
If he is found guilty, at sentencing the judge can & does consider all mitigating factors. It would be a good idea that you get as many people as possible to come to Court & speak of his good character.
