Legal Question in Criminal Law in New Jersey
I live in Wrightstown, NJ and my husband was charged with domestic violence. I am not pursuing the charges but the DA is. I do not want to testify against him. He has never had any criminal charges against him here, or anywhere else. I am wondering what the likelyhood of him having to serve jail time on this first and only offense? He is the soul provider for our home and if he goes to jail he will lose his job...then that will leave us in a very bad situation. Also, with that being said, will that have any bearing on whether he serves jail time?

You could hire your own attorney and have him/her help prevent you from having to testify.
Even if you don't testify the police can still proceed on the case against your husband - It will just be harder for them to prove their case. The likelihood of a first offender doing jail time is not that high, but on a domestic violence case there is a possibility that he will get some time.
