loittering to commit CDS offense

recieved a ticket for loitering to commit CDS offense 2c.33.21.b in Patterson, NJ. I was ripped out of my car and serched. nothing was found. it was in a high drug area. wat do i do? wat can happen to me? do i need a lawer? wat kind of offense is this? does it stay on my record and do i lose my liscens?

It is a criminal offense and you will get a criminal record if convicted. I would get an attorney as you have nothing to lose by getting one and it shouldn't be that expensive.

It is called a disorderly person's offense and it will stay on your record forever unless you get it expunged, but to do that, you have to wait 5 years. Then you have to file a motion which has to be gratned by a judge. You will need a lawyer for that as it can be complicated to do it by yourself.

It is a part of the criminal code, and if convicted of it you will have to wait 5 years to expunge it from your record. However, if you get a lawyer you may have a chance to have this downgraded to a lower charge that may not result in a criminal code conviction, or resolve the case without need for a guilty plea, if court permits a more creative resolution. THis is a violation of the criminal code, although it is a relatively small violation known as a Disorderly Persons Offense. Nevertheless a conviction on this charge would result in your having a criminal record. You would also have to pay fairly high fines, and at least potentially be looking at some jail time - the law says that you can do up to 6 months in jail if you are convicted of this charge. It does not carry an automatic suspension of your driver's license like other drug charges do. I would certainly recommend that you hire a lawyer. There may even be a way to actually beat this charge from what you described in your message. I am an attorney who has handled many cases similar to yours in various courts in New Jersey in the past.
