how long do the state of nj have to indict someone on the charges of conspiracy to armed robbery

Rule 3:25-3 of the New Jersey Court Rules provides that if there is an unreasonable delay in presenting the charge to a grand jury or in filing an accusation against the defendant who has been held to answe3r upon a complaint, the assignment judge or the assignment judge's designee, may dismiss the matter on his own or on the motion of the defendant. This motion can be granted based upon four considerationsm, (1) lenhgth of the delay

(2) reason for the delay (3) the defendant's assertion of his right to a speedy trial and (4)

the prejudice to the defendant resulting from the delay. There is no specific time period within which

an indictment must be obtained, under the court rules.

The state has five years to bring a charge against you under N.J. Statutes 2C:1-6. I am an attorney who has handled many cases similar to yours in various courts throughout New Jersey in the past.
