Legal Question in Criminal Law in New Jersey

LSD Laws

I have been charged with intent to distribute ''under 100 milligrams'' of LSD. It is possible that the weight of the ''carrier'' blotter paper is more than 1 gram, enough to impose the five year mandatory minimum. If I plead guilty to the charge, can they weight the paper and impose the mandatory minimum, even though I did not plead guilty to that amount?

Re: LSD Laws

If you enter into a plea, the case is over. They can't start messing with your case at that point.

I wouldn't be in such a hurry to plead guilty. There may be a lot of ways to fight your case. Feel free to call me at 732/247/3340 to discuss it.

Re: LSD Laws

You question should be specifically addressed in whatever plea bargain you agree to. Your lawyer should make strong efforts to persuade the prosecutor that the mandatory minimum should not apply in your case.

Call me if you like.
