Marijuana & Other Charges

My 3 friends and I were hanging out in his car in front of my friends house. His mom called the cops and we all got charged with possession of marijuana( it was probably less than 1 gram!), marijuana pariphanelia( burnt joint, rolling papers), and smoking marijuana(i didnt know they could charge you with this). They also had open beer in the front seat of the car. So we were charged with open container. my one friend had everything on him but they arrested all of us and charged us all with the same thing. My friend and i were sitting in the back seat and had nothing on us. They didnt even give us a breathalyzer. My question is am i going to lose my license??? Could i get this conditionally discharged?

the minor marijuana charge can be conditionally discharged and the other charges can be managed.

The answer to your questions are yes and yes. Even with the CD, some judges still want to take your DL. I don't like to blindly suggest taking a CD. It can have serious ramifications for you. I suggest meeting with an attorney that will look over the case and fight for you. From the facts as you presented, I think you stand a great shot of getting everything dismissed.
