Legal Question in Criminal Law in New Jersey

Marijuana NJ

When getting arrested in NJ for under 50 grams of Marijuana. I am a first timer. I was told by my attorney that I will be granted a conditional discharge. However I had plans to move out of the country come Sept 8th to Israel. I have two questions, could I potentially get an absolute discharge? and secondly If not, will I have difficulty leaving the country so soon after my hearing which is on Aug 6th? Thank you

You have to work it out with the prosecutor and the judge that your period of supervision, as part of your conditional discharge, will be served in Isreal, with you sending in a completed form each month to the probation officer who will supervise you until you complete your supervisory status as a condition of your conditional discharge. I have done

for clients of mine who lived in other, distant states in this country who never returned to New Jersey.

Of course, you can not come and go. This will not work as well if you are going to Isreal on vacation and coming back in three months, although it might.

You have to be careful. Technically, a conditional discharge is probation and you are not permitted to leave the country without permission. Some counties treat it much more seriously than others. It depends on where your case is. Call me if you would like to discuss it further at 877*688*3879.
