Marijuana possession

Me and my boyfriend were caught 1 hour after smoking marijuana. We had nothing visible around us, however we were caught because of smell. Someone called the police without even telling us what was going on. The police came arrested us and we handed over what we had. Less than 50 grams and paraphenalia. We went to court, were forced to plead not guilty and now have to pay for a public defender. I am 18 and my boyfriend is 20. This is the first offense for both of us and we have clean driving records. What should we do when meeting with the defender and what will the sentencing be in most cases?

The court is protecting your right to counsel because these offenses have the POTENTIAL for jail time. HOWEVER, that is unlikely based on your post. You might also have grounds for a suppression motion, but you would need to discuss the details of your arrest with a qualified criminal defense attorney. Make sure you ask for a conditional discharge. This means that you will be placed on probation and if you do well the case will be dismissed against you.
