Legal Question in Criminal Law in New Jersey
Mind Bender Help
okay i am from jersey i have been out on bail for 5 years and my charges stem from almost 7 years ago with no trail date. I have a miranda hearing soon and my case that I am trying to use is that I was questioned for 14 hours upon arest and never givin the oportunity to remain silent. I asked for a lawyer they would leave come back and question again and again. They are trying to also use the fact that they picked me up a week before and questioned me never arested me just asked questions and i answered some. My lawyer said that i was questioned but at the thought that they had control of me meaning i could go no where because if i did no co-operate would they let me go. Here is my question based on 14 hours of questioning do i have a strong case for miranda. Also am i able to have a judge not associated with my case to hear the miranda. I have read what miranda was based on and i wanna know if it is really a hearing or just another waste?

Listen to your lawyer. You COULD have a strong Miranda issue.
