Minor as a witness in a criminal case

Can a minor be supeoned to testify as a witness in a criminal case where the defendant is also a minor? If so, is the supeona enforceable against the minor if the minor does not appear?

If the minor cannot be supeoned, can the party supeona the parent on behalf of the child?

What is the age of a minor in New Jersey?

Is there anything else that I shoild know regarding minors as a witness? Also,Is there any case law or statutes that reference these issues?

yes, yes & yes. age of minor is less than 18 years old. it is best to find case law at your county law library. if in Bergen county, go to the county courthouse law library.

A subpoena is a court order. It is signed by the party's attorney who is authorized by court rule to sign the name of the court clerk. No one is exempt from a court order unless application is successfully made for a court order for such an exemption.
