Legal Question in Criminal Law in New Jersey

molestation

my 13 year daughter accused me of molesting her from the age 5 to 13 . from the age 5 to 71/2 she was with me and her mother she claimed that i molested her during this period through oral sex while her mother was at work . from the age of 71/2 to 11 she lived with me and my current wife on the week ends . my wife was interview by investigators and she stated that there were no signs what so ever of me ever molesting my daughter . she stated that she was a stay home mom while my daughter was visiting and she would have seen some indication of abuse if it was present . my daughter told investigators that i molested her every week end , my current wife told them that i worked monday - saturday and she would have seen something if it was happening . there is no physical evidance indicating abuse child was examined by doctor what our my chances of beat this case if it goes to trial the case is been setting for 9 months with out and arrest , we were informed that there trying to build as case.

You should hire a lawyer. My experience has been that when you have a kind of unclear situation like this, once a lawyer gets involved the police frequently back off. If this case has been pending for 9 months without charges being filed there is a good chance the same thing would happen in your situation. The problem is that a child can appear less reliable than an adult and still be believed. You will have to be content with the fact that you DO have defense.
