Legal Question in Criminal Law in New Jersey
My nephew (age 19) was at a small party where there was drinking going on . things escalated with a couple of people, cops showed up. He wasn't arrested, he wasn't given any type of test, the cop didn't even ask to smell his breath. several days later he gets a ticket in the mail for under age drinking. would you advise him to plead not guilty ? There's no proof that he was or wasn't !!

The police might lie and say that her breath smelled of alcohol.
