Legal Question in Criminal Law in New Jersey
NJ Speedy Trial rights in New Jersey
Under the constition of the US and New Jersey, it states that each person has the right to a fair and speedy trial. My question is, what is the time frame from start to finish.. In Nj is it from arrest(being charged) to completion or is it indictment to completion. All i have been able to find was 180 days but it does not explain more than that. Please help..

Trust me, NJ courts try to push criminal cases as quickly as possible. I doubt you'll even have a good argument for speedy trial. Don't waste your time on that and focus more on the case itself. If you have a pending charge, it doesn't seem like you trust your lawyer. If you'd like to discuss the case, give me a call.
Re: NJ Speedy Trial rights in New Jersey
Some states, such as New York, have a speedy indictment, statute or court rule requiring indictment within a certain time period. New Jersey does not. In New Jersey one most make a motion for a speedy trial in order to complain of being denied same. Once the motin is granted then the State's failure to move a matter for trial within a reasonable time period is a basis for dismissing the criminal matter.

The answer to your question is fact specific, meaning that each case will be decided based upon the facts of that particular case. If in fact you have a pending criminal charge against you, please contact me to discuss it so I can give you a more specific answer as to your specific case.
