Legal Question in Criminal Law in New Jersey

NJS 2C:33-4A and NJS 2C:33-4C

I was charged with these two violations from the owner of a cleaning company whom I won a $2200 judgment against. Her employee stoled $2200 from my home and confessed the crime to police 3 months later, I took the owner to small claims court and won judgment on money stolen.

Prior to the judgment, I went to her house to deliver discovery that she needed for the small claims court, she screamed at me and told me I was supposed to mail it, I tried to explain to her that I just got the paperwork and court is the next day which leaves me no time to mail it, she slammed the door in my face. I then use some vulgar language after the door was shut and she went to the police and file these charges. I found out late she taped what I said. During mediation with these charges, I apologized for the language used, and she would not accept my apology, she told the mediator that she want this on my permanent record, as the mediator start writing the paperwork for trial, her husband said that they would drop the charges if we would drop the judgment against them. I would not, we went to trial today and with one look at the charges, the judge looked at me and told me I should get a lawyer because if found guilty, I could go to jail. Any advise?

You should follow the advice of the court and get a good attorney. This case should be blown out of court pretty quickly just based upon the facts that you provided. You need to fight back hard against her and then you might have another law suit against her when you are done.

I have an office in Toms River so call me at 732/247/3340 to discuss your case. I'll be around all weekend.
