Legal Question in Criminal Law in New Jersey
N.J.S. 2C:35-10A(4) (A DP Offense)
My 18 year old son was questioned by police while sitting on the beach with friends (at night). He had a small amount of marijuana with him in a small plastic bag which he admitted to having. He was charged with the above and must appear next week for a hearing. This is his first offense. Can you give me an idea about what to expect for penalties/fines, etc.?

If this is his first offense and it is alleged to be less than 50 grams of marijuana, he would be eligible for first offender treatment, which involves a period of supervision by a probation officer leading to the dismissal of the charge. There would still be approximately $600.00 in fines and assessments.

Please remember that a Disorderly Persons offense is still a violation of the criminal code and your son is facing up to six months in jail an up to a 2 year loss of his driver's license if he is convicted. That having been said, I would say that you have two choices. From what you describe this may have been an illegal search of your son. If you want to fight this by filing a motion to suppress the evidence you may actually win the case and the whole thing will be over. The other alternative is to ask to be allowed into a program called the Conditional Discharge program which is a one year probationary program where, if you comp,y with all the terms of the program, the criminal charge is dismissed and you don't have a record. You have to pay a couple of thousand dollars in fees to enroll in this program and you are subject to random urine screening during the time you are on probation.
