Legal Question in Criminal Law in New Jersey
NJSA 2C:20-3a charge
My friend's 19 year old son was charged with NJSA 2C:20-3a. He thought it would be funny to move those neon figures that you place in the street to warn drivers, ''caution child at play.'' He didn't actually move the figure, but a girl who was in the back seat of his car (he was driving) jumped out and grabbed it. He drove down the street a few miles and dropped it off. The owner of the figure took his plate number down and called the police who tracked him down and arrested him and charged him with the above charge. What are his options. His court date is March 22nd.

His options are to plea guilty and get a criminal record and face some punishment or get an attorney to fight this case with everything you got and get the case dismissed so he does not have a criminal record. That's all there is to it. I think he has a great case, but a lot of it will come down to how its presented. I suggest he get an attorney ASAP.

If a friend robs a bank and ask you for a ride in order to get away you are going to be charged with a bank robbery. Your son facilitated the taking of the item on the street. He committed a theft. Abandoning the item at another location does not cancel out the theft, only returning it to the location of the taking could cure the theft.
He needs a lawyer NOW.
