Legal Question in Criminal Law in New Jersey

N.J.S.A. 2c:33-4a

I was charged with N.J.S.A. 2C:33-4A in 1997 (11 Years ago) and the charges were dismissed. My current employer is questioning if this a felony. It showed up on my record when filing my U-4. I gave them the paperwork that the courts had (which wasn't much because its so old) and explained that it is not a felony. I also gave them a letter from an attorney stating that it is not a felony. This was not good enough for them. I am not sure what else to give them. I would also like to have this expunged from my record. Please advise. Thanks

This is not a felony.

It is a petty disorderly persons offense.

You are eligible to have it expunged from your record. In fact, it could have been expunged immediately after the charge was dismissed.

You seem to be asking two questions. The first, how do I convince my employer that a disorderly persons harrassment offense is not a felony. That really isn't a legal question. It isn't a felony of course. If they look at the statute, it clearly says that it is a disorderly persons offense. By definition that isn't a felony.

As to your second question, Can you have this expunged from your record, happily the answer is yes, you can easily have it expunged. There is an application process, with a petition filed in the county where the offense occurred, on notice to the local police, local court, county prosecutor, other agencies who keep the records. A hearing date is set. If there are no objections, and in yhour case objection is unlikely, the court will sign an order sealing your record. You send the order to all of the agencies nmentioned before. That is it. It is simple. Some people do it themselves, most hire a lawyer.
